GENERAL INFORMATION: Terms and Conditions
SHIPPING INFORMATION
Air Shipments Authorization for air shipments must be received in writing before shipment will be made. It is the responsibility of the ordering party to be sure this authorization is received in a timely manner.
C.O.D. OrdersC.O.D. orders will not be accepted.
Drop or Split Shipments There is a $10.00 charge for each drop or split shipment after the first shipment. Any order in broken case lots will require a specific quotation and this will result in a substantial up charge. Mustang will not be responsible for any damaged order reshipped from the first drop point. All multiple drops are FOB London Ont.
FOB Points and Freight Claims Single point shipments are made FOB London Ont. All Freight claims are made FOB London Ont. Title and responsibility for the goods passes to the buyer upon tendering of the goods to the carrier at the FOB point. Claims for damages or delays in transit must be filed with the carrier if shipping collect or third party. As a courtesy, Mustang Drinkware will initiate a claim upon your request if the order was shipped on our account number. All freight claims must be made within ten (10) working days of shipment.
Freight Charges Unless otherwise specified, all shipments will be sent freight prepaid. Mustang Drinkware reserves the right to submit additional freight billing from the carrier after the original invoice is issued for miscellaneous fees including, but not limited to: inside delivery, residential delivery, re-delivery, address corrections or brokerage fees billed by the carrier after the first invoice is generated. Mustang will provide freight estimates. However, estimates are not guaranteed and Mustang will not be responsible for the final freight billing. Credit will not be issued if final freight charges are different than quotation given. Full value insured shipments must be clearly stated on your order. Unless otherwise specified, Mustang Drinkware reserves the right to ship your order by the method we deem to be the most efficient manner. This means that we will ship the best method to get your order to the final destination on time and intact.
Inside and Residential Deliveries Orders requiring inside or residential delivery must be noted on your order. Failure to do so may result in delayed delivery and additional freight charges forwarded to you after the initial invoice is issued. Mustang Drinkware will not be held responsible for third party charges resulting from incorrect addresses.
UPS/Purolator/Parcel Post Shipments Glassware and ceramics are generally not suitably packaged for small package carrier shipment. If you require shipping via small package carrier, we must repack the order into protective cartons at $4.95 charge per carton. This charge is in addition to the freight charge and will be incorporated into the total freight billing, unless shipping third party or collect, in which case it will be itemized on the invoice. If you experience breakage, we can initiate a claim for you, only if we shipped on our account number. Third party or collect claims must be filed by account holder. Please retain the original package at the original delivery location for possible carrier inspection. Claims for damage must be filed within 10 days of shipment or no consideration can be given.
NOTE: If you decline the use of overpack cartons, it is understood that Mustang Drinkware is not responsible for any breakage claims. Minimum order to replace breakage is 36 pieces.
There will be a $35.00 charge for special handling of Parcel Post shipments. Shipping via Parcel Post will increase the post production shipping process by 2 business days. Mustang Drinkware will not be responsible for lost or damaged goods shipped via Parcel Post.
MISCELLANIOUS INFORMATION
About our Products Glass and ceramic items are imprinted by direct screen printing or ceramic decal and fired at a temperature of approximately 1100° F and 1450° F, fusing the imprint to the item. All ceramic imprints, except metallic gold, platinum and copper and imitation gold, platinum and copper are dishwasher safe. Stainless Steel, Acrylic, Polycarbonate and Neonware items are printed with organic enamels and are not considered dishwasher safe. Chromeware items should not be used in a commercial dishwasher. They are home top shelf dishwasher safe. They cannot be used in a microwave. We cannot accept any orders calling for exact quantities on Chromeware because of the complex nature of this process. Chromeware is an exclusive process of Mustang Drinkware.
Billing and Shipping Address If no shipping address is noted on an order, the order will ship to the billing address. If the shipping address is “to follow”, note this on the order. Production of your order may be delayed until the receipt of the shipping address on orders marked “shipping address to follow”. These delays are the responsibility of the ordering party.
Catalog Imprints Products and logos shown in this catalog appear only to illustrate the ability to include messages and art on them. They are not intended to suggest that the imprints were designed by this company or that products with specific imprints are readily available to any purchaser without permission of the owners of the trademarks or copyrighted art. Photographs in this catalog may not depict the true item color. If color is essential, a random sample should be ordered.
Ceramics Use in Foodservice Porcelain and stoneware products shown in this catalog other than on pages 47 - 49 are not recommended for continual use in a bar or restaurant environment. All capacities are approximate and should not be used as a standard measure.
Claims and Returns Claims, other than those involving freight carrier, must be made within 30 days after receipt of shipment. Before any complaint is processed, we reserve the right to inspect several production pieces. Shipments returned without our permission and an RA # will be refused. Mustang Drinkware will not be held responsible for the inability to fill orders due to strikes, acts of nature, shortage of materials or any other reasonable cause.
Complete Orders A complete, shippable order with camera ready art and all necessary information will ensure the fastest turnaround of your order. Call backs for clarification may cause a delay in shipping your order. Any credit issues may hold up your purchase order. Your purchase order is a legal document; any changes must be confirmed in writing. Mustang Drinkware is not responsible should a duplicate shipment occur because “confirming” did not appear on follow up purchase order.
Country of Origin Selected glassware and ceramic products in the Mustang Drinkware line are imported and may be identified with the country of origin.
Credit Terms Credit terms must be approved by the factory. Once approved, terms are Net 30 days. A 1 1/2% carrying charge per month will be assessed on past due accounts.
GENERAL INFORMATION
Inventory Availability Quotes
Inventory availability is based on current quantities available at the immediate time of that quote. These quantities can change without notice and can only be guaranteed and mortgaged with receipt of a firm purchase order.
Imprint Colors Please specify PMS number for imprint color(s) on the order. While we offer many standard imprint colors, some colors, such as Rhodamine Red, Rubine Red, hot pink and bright purple, cannot be achieved with the ceramic color palette available for high firing on glass and ceramics. If you choose one of these colors, we will notify you for an alternative color choice. An exact color match cannot be guaranteed due to the nature of the firing process. Variations can also occur due to substrate color, opacity, and other factors. Because of the nature of ceramic enamels we cannot guarantee exact matches from speculative / pre-production sample to the production run. All ceramic colors are dishwasher safe. Satin Etch is a popular imprint color often used on glassware. This is a screen printed application. Mustang Drinkware does not employ a deep etch process.
Multi-Color Design Registration When multiple colors are used in a design, a variance of +/- 1/16” may occur and must be considered acceptable. If tighter registration is required, it can be achieved by the use of a decal, but will require a special quotation and additional lead time. Decals are applied by hand and variation of position will occur. Exact straightness and positioning cannot be guaranteed. Slight variations should be considered acceptable.
Overage and Underage As all items are made to customer’s special design, exact quantity shipments are not guaranteed without an additional charge. All items may be shipped as much as 10% over or under on orders of 288 or less and 5% over or under on orders of 289 or more. Exact quantity shipments are available at an additional charge of 5%. All decal and chromeware orders are subject to a 10% over or under run of the quantity ordered.
Proposition 65 Items designated with an *, sold or distributed in the State of California, may require a warning under a California law, The Safe Drinking Water and Toxic Enforcement Act of 1986, (often referred to as “Proposition 65”). See additional information and policy guidelines under Proposition 65, page 93.
Quality of Ceramics and Glassware Mustang Drinkware offers a broad line of appealing and cost effective promotional products. Because of the processes involved, glassware and ceramics cannot be guaranteed 100% consistent and no two items are guaranteed identical. Variations in materials, firing temperatures, glazes and pigment can cause variances in the final product, which must be considered acceptable. Blank size and color variation may occur within an order and from order to order, but within reasonably established standards for variance. All product sizes are approximate and subject to change without notice. Representative samples are available for evaluation at no charge.
Rush Delivery We will try to accommodate rush orders whenever possible. If shipment is required in less than normal production time, the order will incur a 15% rush charge. You assume all liability for accuracy of imprint, imprint colors and placement. Factory approval is required for all rush orders.
Safety of Imprints and Products Mustang Drinkware is a leading supplier of decorative beverage ware. Mustang Drinkware adheres to FDA regulations regarding the use of decorating materials by not using ceramic enamels that contain lead or cadmium in excess of the FDA standards in the top 2 cm of the lip and rim area of any drinkware. Imported ceramics are tested by our suppliers and adhere to all regulations.
Trademarks You must own the intellectual property rights to the artwork or copy submitted for imprint or by way of assignment are authorized to submit the art or copy. By submitting artwork or copy, you and your client agree that you are in compliance with all laws related to trademark, copyright, and all other intellectual property rights in the artwork or copy submitted. Mustang Drinkware disclaims all liability for non-compliance with these laws.
